THESE TERMS REQUIRE THE USE OF ARBITRATION ON AN INDIVIDUAL BASIS TO RESOLVE DISPUTES, RATHER THAN LITIGATION IN COURT, JURY TRIALS OR CLASS ACTIONS. BY PLACING AN ORDER FOR PRODUCTS FROM THIS WEBSITE, YOU ACCEPT AND ARE BOUND BY THESE TERMS AND CONDITIONS. YOU MAY NOT ORDER OR OBTAIN PRODUCTS FROM THIS WEBSITE IF YOU (A) DO NOT AGREE TO THESE TERMS, (B) ARE NOT AT LEAST 18 YEARS OF AGE OR ARE NOT OF LEGAL AGE TO FORM A BINDING CONTRACT WITH DE AGOSTINI PUBLISHING USA, INC., (C) DO NOT RESIDE IN THE UNITED STATES OR ANY OF ITS TERRITORIES OR POSSESSIONS, OR (D) ARE PROHIBITED FROM ACCESSING OR USING THIS WEBSITE OR ANY OF THIS WEBSITE’S CONTENTS, GOODS BY APPLICABLE LAW.

These terms and conditions (these “Terms”) apply to the purchase and sale of products through www.deagostini.com/us (the “Site”). These Terms are subject to change by De Agostini Publishing USA, Inc. (referred to as “us”, “we”, or “our” as the context may require) without prior written notice at any time, in our sole discretion. The latest version of these Terms will be posted on this Site, and you should review these Terms before purchasing any product that are available through this Site. Your continued use of this Site after a posted change in these Terms will constitute your acceptance of and agreement to such changes.

These Terms are an integral part of the Website Terms of Use (www.deagostini.com/us/terms-of-use/) that apply generally to the use of our Site. You should also carefully review our Privacy Policy (www.deagostini.com/us/privacy-policy/) before placing an order for products through this Site (see Section 9).

Please note that if we accept orders as agents on behalf of third-party sellers which we may or may not do at our discretion, any legal contract will be between you and that third-party seller, and is subject to the terms and conditions of that third-party seller. You should consult such third-party sellers on, and carefully review their terms and conditions applicable to such transactions.

Order Acceptance and Cancellation

You agree that your order is an offer to buy, under these Terms, all products listed in your order. All orders must be accepted by us or we will not be obligated to sell the products to you. We may choose not to accept any orders in our sole discretion. During the order process, you will have the opportunity to check and if necessary correct the contents of your order and all the information you have given. After having received your order, we will send you a confirmation email with your order number and details of the items you have ordered. Acceptance of your order and the formation of the contract of sale between you and us will not take place unless and until you have received your order confirmation email. You have the option to cancel your order at any time by emailing us at the email set forth at the end of our Website Terms of Use (www.deagostini.com/us/terms-of-use/) under Your Comments and Concerns. The products offered on the Site are only on sale for the period in which the offer is online and while stocks last. If a product is not available, we undertake to inform you at the time of ordering or as soon as possible by letter, e-mail or telephone.

Prices and Payment Terms

(a) All prices posted on this Site are subject to change without notice. The price charged for a product will be the price in effect as displayed on the product page and customer portal at the time the order is placed. Price increases will only apply to orders placed after such changes. Posted prices do not include taxes or charges for shipping and handling. In addition to the prices, we will present to you at checkout estimated tax and charges associated with the first shipment of your order. Unless we inform you otherwise, we do not charge you for shipment and handling of the first shipment of your order, and you will see such fees crossed out at checkout. Unfortunately, we cannot and do not present at checkout or in the confirmation email the shipment and handling costs for the shipments of your order after your first shipment. All such taxes and charges will be added to your merchandise total we charge you in the end. If you have any questions on any amounts we charge, please contact us at support@usa.deagostini.com. Our Site contains a large number of products and it is always possible that despite our best efforts, some of the products listed on our Site may be incorrectly priced. If a product’s correct price is higher than the price stated on our Site, we will normally, at our discretion, either contact you for instructions before dispatching the product, or reject your order and notify you of such rejection. We are under no obligation to provide the product to you at the incorrect (lower) price even after we have sent you an order confirmation email if the pricing error is obvious and unmistakable and could have reasonably been recognized by you as a miss-pricing.

(b) Terms of payment are within our sole discretion and, unless otherwise agreed by us in writing, payment must be received by us before our acceptance of an order. We only accept credit cards for purchases. You represent and warrant that (i) the credit card information you supply to us is true, correct, and complete, (ii) you are duly authorized to use such credit card for the purchase, (iii) charges incurred by you will be honored by your credit card company, and (iv) you will pay charges incurred by you at the posted prices, including all applicable taxes, if any.

Shipments; Delivery; Title and Risk of Loss

(a) We will arrange for shipment of the products to you. Please check the individual product page for specific delivery options. You will pay all shipping and handling charges specified during the ordering process. Unless otherwise agreed, your order will be delivered to you within approximately 8 business days from the date your order has been confirmed. The delivery address to which your order shall be sent will be the address provided by you during the ordering process.

(b) Title and risk of loss pass to you upon our transfer of the products to the carrier. Shipping and delivery dates are estimates only and cannot be guaranteed. We are not liable for any delays in shipments. Ownership of the products will only pass to you when we receive full payment of all sums due in respect of the products, including delivery charges as applicable.

(c) We do not accept orders for goods from our Site for delivery outside the United States.
